Do I need title insurance?
We generally recommend title insurance on almost all real estate transactions. For a one-time fee, title insurance can protect you, your business partners, and your loved ones from certain title defects, fraud, registration issues, and other risks that may not be discovered until years later while you still own the property.
How much does a typical residential purchase or sale transaction cost?
For standard residential purchases and sale transactions under $750,000, we charge $1,000 plus HST and disbursements. If you are obtaining a mortgage from a major Canadian bank, it’s an additional $100 plus HST in fees, and for all other lenders, it can be another $200 to $300 plus HST in fees, depending on the lender. The total “all-in cost” including disbursements, is typically around $1,900. For a sale we charge $1,000 plus HST and disbursements. Your “all in” cost with disbursements is usually around $1,500 for a sale. We charge a flat legal fee (and we can provide a quote). Disbursements are additional and depend on the transaction.
What happens after I retain your office?
Once we open your file, we collect the key transaction details, review the agreement and deadlines, coordinate with your realtor, lender, broker, and the other lawyer, and prepare the documents needed for closing. We keep the process organized so you understand what is required, when it is needed, and what to expect before closing day.
When should I contact a lawyer?
Ideally, before you sign. Once an Agreement of Purchase and Sale is accepted, it becomes a binding contract. Having a lawyer review it early can help you understand your obligations, identify potential issues, and feel confident before you commit.
What if my closing date is coming up quickly?
Contact us as soon as possible. Real estate transactions are deadline-driven, and the earlier we receive your documents and instructions, the more options we usually have. If timing is tight, we will review the file, tell you what is realistically possible, and work to move the transaction forward as efficiently as we can.
Can you help with private mortgages?
Yes. Private mortgages are one of our core real estate practice areas. We act for both borrowers and lenders, help the parties confirm key transaction details, prepare clear documentation, and complete the registration and closing steps properly.
